Terms of Trade
1. General
1.1
These general terms and conditions ("Terms") apply when you as a consumer/customer ("You") make a purchase via byensprofiler.dk ("Website"). Agreements are concluded between you and Byens Profiler ApS, CVR number 45541967 ("Byens Profiler ApS"). Contact information and other information about Byens Profiler can be found on the Website. The Terms and Conditions only apply to you as a consumer/customer, ordering via byensprofiler.dk.
1.2
To order on the Website, you must be 18 years of age or older. According to Danish law, Byens Profiler does not accept purchases from persons under the age of 18. Byens Profiler reserves the right to reject or change your order in individual cases (if, for example, you have provided incorrect personal information, make repeated claims on your right of return or have payment notes).
1.3
Byens Profiler reserves the right to correct any out-of-stock items as well as any image or typing errors on the Website, such as incomplete product descriptions, technical specifications or incorrect information regarding stock status. Byens Profiler has the right to correct any such errors and to change or update the information on the Website at any time. If an incorrect price is stated for an item that you have ordered, Byens Profiler will inform you of this by email and await your acceptance of the corrected price before Byens Profiler will proceed with the order. All image information on the Website shows 3D models of the size and scale of the product, and these are not necessarily an accurate representation of the selected area. If an exact display of the desired area is desired, this can be requested by email by stating the correct coordinate code for the area.
1.4
The website and all content on it are owned by Byens Profiler. The information is protected by, among other things, intellectual property and market laws. This includes product names, images, design and all text on the website. This may not be copied or used without prior written approval from Byens Profiler.
2. Agreement and order
2.1
In order to make a purchase through the Website, you must accept the Terms. By accepting the Terms, you agree to follow the Terms in their entirety and acknowledge that you have read the information about personal data and consent to the use of personal data and cookies in accordance with the Byens Profiler Privacy Policy.
2.2
A purchase agreement is only concluded when Byens Profiler has confirmed your order and you have received an order confirmation from info@byensprofiler.dk via e-mail. You can revoke your order up to the time it is confirmed by Byens Profiler. If the order is revoked, Byens Profiler will refund any payments that you or your payment or credit card companies have made in connection with the order.
When ordering, payment is taken immediately, as this is a custom-made work of art. This is in accordance with Section 18(2)(3) of the Danish Consumer Agreement Act , which stipulates that the right of withdrawal does not apply to the delivery of goods that have been manufactured according to the consumer's specifications or have been given a clear personal touch.
3. Customer information etc.
3.1
When you register your user account and/or make a purchase, you will be asked to provide personal information. You confirm that the information you provide is correct and complete and are responsible for any incorrect information. Information about Byens Profiler's processing of personal information can be found in Byens Profiler's Privacy Policy.
3.2
You undertake to ensure that no one else can use your login information. You may not disclose your username and password to others, and you must ensure that written information about your username and password is stored in such a way that unauthorized persons cannot access the information. You must immediately notify Byens Profiler if you suspect that another person has gained access to your password for the Website. You are responsible for all purchases made with your login information if you have not sent such notification to Byens Profiler.
3.3
If Byens Profiler suspects that you are abusing your user account or your login information or otherwise violating the Terms, Byens Profiler has the right to block your account. Byens Profiler also has the right to assign you new login information.
4. Prices, fees and payment
4.1
When ordering via the Website, the prices stated on the Website apply. The prices are either VAT-free or subject to a reduced VAT rate of 5%, depending on Byens Profiler's VAT status. Byens Profiler is subject to the rules for artistic activities pursuant to Section 48 of the Danish VAT Act .
4.2
You can pay in the ways indicated on the Website. Byens Profiler is entitled to payment when a purchase is made. Byens Profiler reserves the right not to always offer all payment methods.
5. Delivery and transportation
5.1
Items purchased on the Site are typically delivered to a personal or business address, unless otherwise specified or requested. Delivery time depends on the size of the product and production time, as set out below:
- A3 : Production and shipping within 14 days (10 business days)
- 50x70 cm : Production and shipping within 21 days (15 business days)
- 60x80 cm : Production and shipping within 21 days (15 business days)
- 70x100 cm : Production and shipping within 30 days (20 business days)
- A0 : Production and shipping within 42 days (30 business days)
- 100x140 cm : Production and shipping within 60 days (40 business days)
- Larger special order : Production and shipping within 90 days (60 business days)
For orders larger than 70x100 cm, delivery will be made through a moving company to ensure proper transport. This applies to formats such as A0 , 100x140 cm , and special orders, and may result in additional delivery time depending on the capacity of the transport company.
If the delivery time is unacceptable to the customer, the order can be cancelled within 24 hours of placing the order. After this period, the order will be considered confirmed and put into production.
5.2
If the package needs to be redeemed, you must do so within the time specified in the notification. The package must normally be collected in person with valid identification and order number. You will always receive a notification indicating where and when the package should be collected. Notifications are sent via email and, if you have provided your mobile number, also via SMS.
If you do not pick up the package and do not inform us that you wish to exercise your statutory right of withdrawal, Byens Profiler has the right to charge a fee of DKK 250. If you order home delivery, it is important that someone is present to receive the package.
